A friend of mine was in a similar situation and the police blamed him for it because it was him that hit the vehicle, even though the vehicle pulled out in front of him. The insurance company also blamed the rider.
I, personally, blame the van driver for being dick but we all know that there's still a large number of other road users that fail to notice bikes regardless of how many adverts they do to prevent this >
